PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THIS AGREEMENT CONTAINS A BINDING ARBITRATION CLAUSE, A CLASS ACTION WAIVER, A JURY TRIAL WAIVER, LIMITATIONS ON LIABILITY, A SHORTENED STATUTE OF LIMITATIONS, AND AN AUTO-ACCEPTANCE PROVISION FOR OFFERS NOT RESPONDED TO WITHIN 48 HOURS. THESE TERMS AFFECT YOUR LEGAL RIGHTS AND REMEDIES.

Welcome to MailGoldOnline.com ("MailGoldOnline," "we," "our," or "us"). MailGoldOnline.com is a nationwide mail-in precious metals purchasing service operated by Solvita Ventures LLC, headquartered at 1335 Douglas Ave Ste. G, Montgomery, Illinois.

By accessing this website, submitting a kit request, submitting items for evaluation, or otherwise using our services, you expressly agree to be bound by these Terms of Service ("Agreement"). If you do not agree, you must not use our services.

1. Acceptance of Terms

You expressly accept these Terms at multiple points:

  • When you submit a kit request via our website
  • When you receive a prepaid shipping label from us
  • When you ship items to us for evaluation
  • When you view, accept, or decline an offer via the offer page
  • When you receive payment from us in any form

Each act constitutes renewed acceptance of these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated to active customers via email when reasonably possible. Continued use of our services after any change constitutes acceptance of the revised Terms.

This Agreement is governed by the laws of the State of Illinois.

3. Customer Representations and Warranties

By using our services, you represent and warrant that:

  • (a) You are at least 18 years of age and have full legal capacity to enter into binding contracts;
  • (b) You are the lawful and sole owner of all items submitted, or you possess full legal authority to sell the items on behalf of the owner;
  • (c) The items are not stolen, counterfeit, fraudulently acquired, encumbered by any lien, security interest, or claim, or subject to any community property, marital property, or other shared ownership claim that has not been resolved;
  • (d) The items are not part of an estate, probate matter, bankruptcy proceeding, divorce proceeding, or other legal matter that would restrict your authority to sell;
  • (e) You have not received the items as a gift, inheritance, or transfer from any third party whose ownership or authority to transfer is in dispute;
  • (f) The items were obtained legally, and you have no reason to believe they were stolen, fraudulently obtained, or otherwise unlawfully acquired even by any prior owner;
  • (g) All information you provide is accurate, complete, and current;
  • (h) You will indemnify MailGoldOnline for any breach of any of the above warranties.

We reserve the right to request government-issued identification, additional verification documentation, or ownership documentation at our sole discretion.

4. Description of Services

MailGoldOnline purchases precious metals including gold, silver, platinum, and palladium in the form of jewelry, coins, bullion, scrap, and related items.

All items are evaluated primarily for precious metal content and intrinsic value unless explicitly agreed otherwise in writing.

We are not:

  • An investment advisor
  • A financial advisor
  • A broker, dealer, or auction house
  • A fiduciary of any kind

All transactions are outright purchases at our sole discretion. We may refuse any transaction for any lawful reason without explanation.

5. Shipping, Insurance, and Risk of Loss

5.1 Company-Provided Shipping Label

Customers may be provided with a prepaid FedEx shipping label. For security reasons, we do not declare insurance value on the shipping label. As a result, shipments using our label are covered only by FedEx's standard liability of up to $100 per package.

If your items are valued above $100, we strongly recommend purchasing additional shipping insurance directly through FedEx or a third-party insurer before sending your package. You acknowledge that you have been advised of this recommendation.

5.2 Documentation Requirements

Customers are strongly encouraged to:

  • Photograph all items before shipment
  • Record video of the packaging process
  • Retain shipping receipts and tracking confirmation
  • Document the weight and identifying details of each item

Failure to maintain documentation may limit your ability to recover losses in the event of a lost or damaged package.

5.3 Risk of Loss

RISK OF LOSS REMAINS WITH YOU UNTIL THE PACKAGE IS PHYSICALLY RECEIVED AT OUR FACILITY AND DOCUMENTED IN OUR SYSTEM. MAILGOLDONLINE IS NOT RESPONSIBLE FOR PACKAGES THAT ARE LOST, STOLEN, DAMAGED, DELAYED, MISDIRECTED, OR UNDELIVERED PRIOR TO CONFIRMED RECEIPT.

5.4 Fraud Prevention

Submission of false information, misrepresentation of contents, or fraudulent insurance claims may result in:

  • Immediate denial of any claim
  • Cancellation of the transaction
  • Refusal of future service
  • Referral to law enforcement
  • Civil action for damages

6. Evaluation Process

6.1 Receipt and Documentation

Upon receipt:

  • Packages are photographed externally and their contents are documented before evaluation begins. These records are retained for our internal use and dispute resolution.
  • You expressly consent to this documentation process.

6.2 Testing Methods

Precious metals may be tested using XRF analysis, acid testing, weighing, magnet testing, density testing, or other industry-standard methods.

Acid testing may leave a small, inconspicuous mark on a discrete area of metallic items as part of standard purity verification. We use non-destructive methods (such as XRF) whenever possible. You expressly consent to these testing methods and waive any claim related to such marks.

Items may be cleaned, separated, or processed during evaluation.

Gemstones are typically not assigned value unless agreed in writing in advance.

Watches, designer items, and branded goods may be evaluated primarily for metal content unless otherwise specified.

We reserve the right to reject any item at our sole discretion.

7. Offer and Price Determination

7.1 Pricing Basis

Offers are based on:

  • Weight
  • Purity
  • Current precious metal market prices
  • Market conditions at time of evaluation

Precious metal prices fluctuate constantly. We are not responsible for price changes occurring before, during, or after shipment.

7.2 Offer Validity and 48-Hour Window

All offers are valid for exactly forty-eight (48) hours from the timestamp the offer is transmitted to you via email and/or SMS notification.

7.3 Auto-Mail Check Policy (48-Hour Offer Expiration)

YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING TERMS REGARDING OFFER EXPIRATION AND AUTOMATIC PAYMENT.

(a) Offer Window. All offers are valid for exactly forty-eight (48) hours from the timestamp the offer is transmitted to you via email and/or SMS notification.

(b) Auto-Mail Check Resolution. If you have viewed the offer page (as defined below) and we have not received your formal acceptance or decline within the 48-hour offer window, you expressly authorize us to automatically:

  • (i) Treat the offer as accepted in full;
  • (ii) Mail a check for the offer amount to the mailing address on file;
  • (iii) Process the items in accordance with our standard refining and resale procedures;
  • (iv) Consider the transaction complete and final upon mailing the check.

(c) Definition of "Viewed the Offer Page." For purposes of this section, you have "viewed the offer page" if our system records any access to the unique offer URL we sent to you, including but not limited to opening the offer page on any device, refreshing the page, or any technical activity indicating page load. This is logged automatically and is considered conclusive evidence of viewing.

(d) Consent Through Use. Your decision to submit items for evaluation, combined with our prominent 48-hour disclosure displayed in:

  • The offer email subject line and body
  • The offer page itself
  • These Terms of Service
  • Our Privacy Policy

constitutes your express, written consent to the auto-mail check policy. You acknowledge that the policy is reasonable, necessary, and material to our business model given the volatility of precious metal market prices.

(e) Customer Responsibility. You are solely responsible for:

  • Monitoring the email account you provided
  • Checking spam, promotions, and other email folders
  • Updating your contact information if it changes
  • Responding within the 48-hour window if you wish to decline
  • Maintaining the mailing address on file for check delivery

(f) Waiver of Reversal Rights. ONCE A CHECK IS MAILED PURSUANT TO THIS AUTO-ACCEPTANCE PROVISION, YOU EXPRESSLY WAIVE ANY RIGHT TO:

  • REVERSE, RESCIND, OR CANCEL THE TRANSACTION
  • DEMAND RETURN OF ITEMS
  • CLAIM NON-CONSENT TO THE TRANSACTION
  • PURSUE ANY CLAIM THAT THE AUTO-ACCEPTANCE WAS UNAUTHORIZED

(g) Uncashed Checks. If you fail to deposit or cash the auto-mailed check within ninety (90) days of mailing:

  • The funds remain payable to you as stated on the check
  • Items submitted for evaluation remain the property of MailGoldOnline as final consideration for the offer
  • After 5 years, uncashed check funds may be subject to Illinois unclaimed property law and remitted to the state

(h) No Liability for Address Errors. If a check is mailed to an incorrect address provided by you, fails to be delivered, or is intercepted by a third party, MailGoldOnline's liability is limited to issuing a single replacement check upon receipt of evidence of the original mailing and verification of correct address. We are not liable for any losses from incorrect address information you provided.

(i) Customer Did Not View Offer Page. If our system records no access to the offer page within the 48-hour window, the offer expires automatically without auto-mail-check action. We will attempt to contact you using the phone number on file. If we cannot reach you within an additional 14 days, items will be returned to you via FedEx at no cost. After return, any subsequent evaluation will require a fresh submission and pricing at then-current market rates.

(j) Market Volatility Justification. You acknowledge that precious metal prices fluctuate significantly within short time periods. The 48-hour window is calibrated to balance customer response time against our pricing exposure and is necessary to maintain operational viability.

(k) Acknowledgment of Disclosure. You confirm that the 48-hour auto-mail-check policy was disclosed to you in:

  • The offer email
  • The offer page disclaimer
  • These Terms of Service
  • Our Privacy Policy

(l) Survival. This Section 7.3 survives termination, cancellation, or expiration of your relationship with MailGoldOnline.

7.4 Offer Finality

After 48 hours, the original offer expires and any new evaluation will be priced at then-current market rates. We are under no obligation to honor any expired offer at the previously quoted amount.

8. Acceptance and Payment

8.1 Customer-Selected Payment Methods

Upon acceptance of an offer, payment is sent according to the customer's selected payment method:

  • Instant transfer methods (Zelle, Venmo, PayPal, Cash App): typically delivered within a few hours
  • ACH or wire transfer: typically delivered within 1–3 business days
  • Check by mail: typically delivered within 5–7 business days

Actual delivery times may vary based on banking timelines, holidays, and processing requirements outside our control.

8.2 Compliance Holds

We may delay payment for identity verification, fraud review, or regulatory compliance. We comply with applicable federal and state anti-money laundering laws, the Bank Secrecy Act, and Illinois precious metals dealer regulations. We reserve the right to request additional documentation before releasing payment.

8.3 Customer Information Accuracy

You are solely responsible for providing accurate payment information. Payments sent to incorrect accounts based on information you provided are not our responsibility, and we are under no obligation to issue replacement payment.

9. Declined Offers and Returns

If an offer is declined:

  • Items will be returned to the customer via FedEx with standard delivery service.
  • Return shipments carry FedEx's standard liability coverage of up to $100. No additional insurance value is declared on the label for security reasons.
  • Market fluctuations during return transit are not our responsibility.
  • Due to testing procedures, items may show minor acid test marks as described in Section 6.2.
  • You expressly waive any claim related to the condition of returned items beyond such testing marks.

10. Communications Consent

By submitting a kit request, you consent to receive transactional emails and SMS messages from MailGoldOnline regarding your order status, including kit shipping notifications, package receipt confirmations, offer notifications, payment confirmations, and follow-up reminders.

Message and data rates may apply for SMS. You can opt out of SMS at any time by replying STOP to any message. You can opt out of email by following the unsubscribe instructions in any email or by contacting us at (630) 593-3510.

We do not sell or share your contact information with third parties for marketing purposes.

11. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
  • WARRANTIES OF NON-INFRINGEMENT
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY INFORMATION PROVIDED
  • WARRANTIES REGARDING THE OUTCOME OR APPRAISAL VALUE OF ITEMS SUBMITTED

NO ADVICE OR INFORMATION OBTAINED FROM US OR THROUGH OUR SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

12. Limitation of Liability

12.1 Damage Cap

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF:

  • (A) ONE HUNDRED DOLLARS ($100), OR
  • (B) THE TOTAL AMOUNT OF YOUR MOST RECENT TRANSACTION WITH MAILGOLDONLINE.

12.2 Excluded Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • RETAIL, SENTIMENTAL, OR APPRAISED VALUE OF ITEMS
  • LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITY
  • LOSS OF DATA OR PRIVACY
  • LOSS OF GOODWILL
  • EMOTIONAL DISTRESS
  • SPECULATIVE MARKET LOSSES
  • ANY DAMAGES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES

12.3 Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, pandemics, epidemics
  • Acts of war, terrorism, civil unrest, riots
  • Government actions, regulations, embargoes
  • Failures of postal services, courier services, or electronic networks
  • Cyber attacks or security breaches affecting our service providers
  • Refinery, processor, or financial institution failures
  • Labor disputes, strikes, or work stoppages
  • Supply chain disruptions affecting precious metals markets

In the event of a force majeure event, we will use commercially reasonable efforts to resume normal operations and to fulfill any outstanding obligations.

13. Indemnification

You agree to indemnify, defend, and hold harmless MailGoldOnline, Solvita Ventures LLC, and their officers, directors, employees, agents, and affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your submission of stolen, counterfeit, or fraudulently acquired items
  • Any breach of your representations and warranties in Section 3
  • Fraudulent insurance claims or misrepresentations
  • Your violation of any law, regulation, or third-party rights
  • Your violation of these Terms
  • Any disputes between you and any third party related to items you submitted

This indemnification obligation survives termination of these Terms.

14. Market Volatility Disclaimer

Precious metal prices fluctuate due to global market conditions. You acknowledge that:

  • We do not guarantee pricing prior to formal written offer issuance
  • All pricing decisions are final upon acceptance
  • We bear no responsibility for price changes that occur during shipping, evaluation, or while you are deciding whether to accept an offer
  • The 48-hour offer window in Section 7 is calibrated to this volatility

15. Shortened Statute of Limitations

ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES MUST BE BROUGHT WITHIN ONE (1) YEAR FROM THE DATE THE CLAIM AROSE. CLAIMS NOT BROUGHT WITHIN THIS PERIOD ARE PERMANENTLY BARRED.

This provision shortens the default statute of limitations that would otherwise apply under Illinois law. You expressly agree to this shortened period in exchange for the services provided.

16. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS.

16.1 Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, our services, your submission of items, our purchase or refusal to purchase items, our communications with you, or any other matter between you and MailGoldOnline shall be resolved through final, binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

The arbitration shall take place in Kane County, Illinois, or via remote proceedings at the arbitrator's discretion.

The arbitrator shall apply Illinois law to all claims, regardless of your state of residence.

The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court having jurisdiction.

16.2 Class Action Waiver

YOU AND MAILGOLDONLINE AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

YOU EXPRESSLY WAIVE ANY RIGHT TO:

  • PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION OR REPRESENTATIVE LAWSUIT
  • BRING CLAIMS ON BEHALF OF A CLASS
  • COMBINE OR CONSOLIDATE YOUR CLAIMS WITH ANYONE ELSE'S CLAIMS
  • A JURY TRIAL

If a court finds the class action waiver unenforceable, the entire arbitration provision shall be void, and the parties agree to resolve disputes in Illinois state or federal court located in Kane County, Illinois, with the class action waiver remaining enforceable to the maximum extent permitted by law.

16.3 Opt-Out Right

You may opt out of this arbitration agreement by sending written notice to:

The opt-out notice must be postmarked within thirty (30) days of the date you first agreed to these Terms. The notice must include your full name, mailing address, email address used with MailGoldOnline, and a clear statement that you wish to opt out of the arbitration agreement. Opting out of arbitration does not affect any other terms of these Terms of Service.

16.4 Exceptions

Notwithstanding the above, either party may bring an individual action in small claims court in Illinois for claims within the jurisdictional limits of that court.

Either party may seek injunctive or equitable relief in court to prevent actual or threatened infringement of intellectual property rights or unauthorized access to or use of our services.

17. Governing Law and Jurisdiction

This Agreement and any claims arising out of or relating to it shall be governed by the laws of the State of Illinois, without regard to its conflict of law principles, regardless of your state of residence.

For any matter not subject to arbitration, the exclusive jurisdiction and venue shall be the state and federal courts located in Kane County, Illinois. You consent to the personal jurisdiction of these courts and waive any objection based on inconvenient forum.

18. Intellectual Property

All content on our website, including text, graphics, logos, images, software, design, structure, and the MailGoldOnline brand name, is the property of MailGoldOnline and Solvita Ventures LLC and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any content from our website without our prior written consent.

Any unauthorized use may result in civil or criminal penalties.

19. Termination

We reserve the right to refuse service, terminate accounts, or cancel transactions at our sole discretion for any lawful reason, including but not limited to:

  • Suspected fraudulent activity
  • Breach of these Terms
  • Inability to verify identity
  • Violation of law
  • Threatening or abusive behavior toward our staff

Termination does not relieve either party of obligations arising before termination.

20. No Private Right of Action for Policy Violations

Except for violations of binding legal obligations under applicable laws, these Terms do not create any private right of action by you or any third party for technical violations of these Terms. Only applicable regulatory authorities may enforce alleged violations except where private right of action is expressly granted by statute.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

The class action waiver in Section 16.2 is non-severable; if found unenforceable, see Section 16.2 for the consequence.

22. Survival

The following provisions survive any termination, cancellation, or expiration of these Terms or your relationship with MailGoldOnline:

  • Section 3 (Customer Representations and Warranties)
  • Section 7.3 (Auto-Mail Check Policy)
  • Section 11 (Disclaimer of Warranties)
  • Section 12 (Limitation of Liability)
  • Section 13 (Indemnification)
  • Section 15 (Shortened Statute of Limitations)
  • Section 16 (Binding Arbitration and Class Action Waiver)
  • Section 17 (Governing Law and Jurisdiction)
  • Section 18 (Intellectual Property)
  • Section 20 (No Private Right of Action)
  • Section 21 (Severability)
  • Section 22 (Survival)
  • Section 23 (No Waiver)

23. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of MailGoldOnline. A waiver of any breach shall not constitute a waiver of any subsequent breach.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MailGoldOnline regarding your use of our services. They supersede any prior agreements, representations, or understandings, whether written or oral, on the subject. No oral or written representations made by our employees, agents, or representatives shall modify these Terms unless in writing and signed by an authorized representative of MailGoldOnline.

25. Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms at any time without notice.
